Terms of Service

Terms and conditions for using Picavo, including plans, billing, refunds, liability, and governing law.

Last updated: 2026-07-17

Acceptance of Terms

By accessing or using Picavo ("the Service") at https://picavo.co, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

Picavo provides AI-powered product photography and video creation tools for ecommerce sellers. Users can upload product photos and generate edited images and marketing videos using artificial intelligence. Our image generation and editing features use GPT Image.

The Service is a digital software-as-a-service product delivered over the internet. Paid access, subscriptions, and credits are made available after payment confirmation, so refunds are subject to the specific limits in the Refund Policy below.

User Responsibilities

  1. Account Security — You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  2. Lawful Use — You agree to use the Service only for lawful purposes and in accordance with these terms.
  3. Content Ownership — You retain all rights to the images and content you upload. You grant us a license to process this content solely for the purpose of providing the Service.
  4. Acceptable Use — You must follow our Acceptable Use Policy, which is incorporated into these Terms by reference.
  5. Prohibited Content — You may not upload content that violates the Acceptable Use Policy, infringes on third-party rights, is illegal, or otherwise violates any applicable laws.

Intellectual Property

The Service, including its AI models, software, and branding, is owned by Picavo and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

Plans and Credits

  1. We offer both subscription plans and one-time credit packs.
  2. Current plan names, included credit amounts, billing cycles, and prices are shown on /pricing and again at checkout before you pay.
  3. Subscription credits are included in the recurring plan. One-time credit packs are purchased separately.
  4. Subscription credits do not roll over unless we explicitly say otherwise for a specific plan.
  5. When both credit types exist in the same account, subscription credits are consumed first, then separately purchased credits.

Billing and Payment

  1. By starting a subscription, you authorize Picavo and its payment processor, Waffo Pancake, to charge your selected payment method on a recurring basis until you cancel.
  2. By purchasing a one-time credit pack, you authorize a single charge for the amount shown at checkout.
  3. Taxes, duties, and similar charges may be added where required by law.
  4. We may update pricing for future purchases or renewals. Any change will not alter an already-paid current billing cycle.
  5. If you dispute a charge, contact bratsurfer@outlook.com before filing a card dispute so we can review the transaction and billing history. We aim to acknowledge billing disputes within 2 business days and resolve confirmed billing errors within 5 business days.

Cancellation

  1. You can cancel a subscription at any time from /settings/billing.
  2. If you cannot access the dashboard, you may cancel by emailing bratsurfer@outlook.com from the email address associated with your account.
  3. Cancellation takes effect at the end of the current billing period. You keep access until that period ends, and we do not renew after cancellation.
  4. Separately purchased credits are not canceled when you cancel a subscription. Their validity remains the same as shown when they were purchased.

Refund Policy

  1. Our full refund terms are set out in the Refund Policy.
  2. Subscription first charges are refundable within 7 days if the account has not used more than 10% of the credits included in that billing period.
  3. Repeated or duplicate charges caused by a billing error are refundable in full.
  4. If service interruption caused by us lasts more than 72 hours, we will offer a proportionate refund or service credit, depending on the circumstances and what is permitted by law.
  5. Unused one-time credit packs are refundable within 7 days of purchase. Used credits are not refundable.
  6. If your account is restricted or closed because you violated these Terms or the Acceptable Use Policy, related charges and credits are not refundable unless mandatory law requires otherwise.
  7. Mandatory consumer rights remain in force and are not waived by this section.

Disclaimer and Limitation of Liability

  1. The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  2. AI-generated output may be inaccurate, incomplete, outdated, or unsuitable for your use case. You are responsible for reviewing, editing, and verifying outputs before any commercial, legal, medical, financial, or other high-stakes use.
  3. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill.
  4. Our total liability for any claim arising from the Service is limited to the amount you paid to us in the 12 months before the event giving rise to the claim, to the extent permitted by law.

User Breach and Enforcement

  1. If you violate these Terms or the Acceptable Use Policy, we may remove content, restrict features, suspend access, or terminate your account.
  2. You are responsible for claims, losses, and liabilities that arise from your unlawful, infringing, or otherwise prohibited content or conduct.
  3. If we terminate the Service for reasons other than your breach, any prepaid but unused amounts will be handled in accordance with the Refund Policy and applicable law.

Governing Law and Dispute Resolution

  1. Except where mandatory consumer protection laws require otherwise, these Terms are governed by the laws of the United States.
  2. Before starting formal proceedings, you agree to first try to resolve the issue informally by emailing bratsurfer@outlook.com.
  3. If informal resolution does not resolve the issue, formal proceedings must be brought in a United States court or forum with competent jurisdiction, unless mandatory local law gives you different rights or a different forum.

Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
